
Like FCC, BEREC bows to activists on open Internet
On Monday, the Body of European Regulators for Electronic Communication (BEREC) released its plan for implementing the EU’s net neutrality rules. In the announcement, Chair Wilhelm Eschweiler declared, “Our regulation is stricter and more robust than the [Federal Communications Commission’s (FCC’s)] and has a much stronger legal basis.” Wanting to avoid the spectacle the FCC endured in 2014, in which millions of computer-generated comments and late-night TV lampoons overwhelmed the agency, BEREC decided to simply give Internet activists want they wanted from the start. BEREC’s capitulation was also evident in February, when the regulatory body invited Barbara van Schewick — a key architect of the activists’ arguments — to advise BEREC on how to develop guidelines.
